Procurement Ethics Policy

Purpose

Clemson University expects its employees to consistently render loyal and efficient service in accordance with all federal and state regulations as well as University policies.

This document and the referenced documents describe practice requirements, interpretations, policies, procedures, and general guidance applicable to government personnel only. They are internal documents that do not have general public applicability and do not create rights or obligations for or against the state. The language used in this document or any promises or assurance contrary or inconsistent with this paragraph does not create any contractual rights or entitlements. The agency reserves the right to revise the content of this document, in whole or in part.


All Procurement and other Clemson employees

Will follow the rules and requirements of the Ethics Reform Act as it applies to state employees located.

Will observe the Clemson University Standards of Ethics.


Procurement Officers

Will follow the policy guidelines outlined by the state. The current state of South Carolina policies have been issued or approved by a Chief Procurement Officer and include the Environmentally Preferred Purchasing Policy, Guidance & Best Practices for Permissible Communications in a Competitive Sealed Proposal, MBE Utilization Plans - "Total Dollar Amount Of Funds Expended," and the P-Card Policy & Procedure.

Will follow the Clemson Procurement Policies. These policies include the Clemson University Conflict of Interest Policies and the Ethics Act Policy.

Will follow the following South Carolina Procurement Law.

Except as specifically authorized to do so, will not disclose any official information that is confidential in nature, represents a matter of trust, and/or comes into their possession as a result of their employment with Clemson.


Evaluation Panel Members

Will not serve on a procurement evaluation panel if they have a conflict of interest.

Will render an independent, impartial, unbiased evaluation of each and every proposal according to the publicly posted evaluation criteria.

Except as specifically authorized to do so, will not disclose any official information that is confidential in nature, represents a matter of trust, and/or comes into their possession as a result of their employment with Clemson.

This Procurement Ethics Policy was adopted by Mike Nebesky, the Director of Procurement and Business Services, on November 14, 2019.
