International Employment
United States Federal law regulates the employment of foreign national individuals. The United States and several foreign countries have entered into tax treaties which have provisions relating to professors and teachers and students. These treaties are revised from time to time; therefore, all appointments offered to internationals should be routed through the Program Director for International Employment & Taxation in the Office of Human Resources prior to the employee starting work.
International faculty, staff, and students may be employed at Clemson University in several different visa categories. Employment visas most often used for faculty and staff are H-1-B, J-1,J2/EAC,TN, or an Employment Authorization Card (EAD). Visas most often used for students are F-1 or J-1.
The International Services section of the Office of International Affairs should be contacted in advance for required visa and immigration services, which may be needed for employment. The Office of International Affairs will assist the department in making a decision regarding the visa category the employee should possess based upon the length of time the department is interested in employing the individual. Departments should provide Office of International Affairs with a copy of the letter of offer of employment.
