Determining FLSA Status

The Office of Human Resources will determine the appropriate FLSA status based on State and Federal laws.

Agricultural Employees

Agricultural employees employed on farms are covered by the Federal Act minimum wage requirement, but non-exempt employees engaged in farming are excluded from the overtime pay provisions of FLSA. Clemson University has, however, elected to treat agricultural workers in positions categorized as non-exempt, the same as all other such employees and to pay overtime after 40 hours worked in a workweek.
